To understand my position on the following issues, you
must first understand my foundation. I am a strict
constructionist, which means I believe that the
Constitution is a document of enumerated powers and it
is to be assessed strictly adhering to the original
intent of the drafters. The authors of the Constitution
had just left an oppressive government that had become
destructive of the ends of freedom. Therefore, they
took great care in prohibiting federal government from
assuming any power not specifically delegated to it by
the Constitution. Thomas Jefferson best sums up my
position in the following:
“I consider the foundation of the Constitution as laid on this
ground: That 'all powers not delegated to the United
States, by the Constitution, nor prohibited by it to the
States, are reserved to the States or to the people.'
[10th amendment.] To take a single step beyond the
boundaries thus specially drawn around the powers of
Congress, is to take possession of a boundless field of
power, no longer susceptible of any definition.” Thomas
Jefferson
We must never forget that we live in a Constitutional Republic
where the individual is sovereign, not the government.
And the government, in its representative capacity, is
governed by the Constitution and is powerless to act
outside of it. The federal government is out of control
and needs to be reminded that WE are the sovereign!
Therefore, it is my firm legal position than any
legislation that addresses matters not specifically
enumerated in Article 1 is wholly unconstitutional and
therefore VOID.
Healthcare is not a function of the federal government
and therefore, the healthcare legislation is
unconstitutional and VOID. Any repeal would be setting a
terrible precedent that unconstitutional legislation can
take effect and must be repealed. As the law stands, an
unconstitutional bill is void, not voidable. The general
rule is that an unconstitutional statute, though having
the form and the name of law, is in reality no law, but
is wholly void and ineffective for any purpose since
unconstitutionality dates from the time of its enactment
and not merely from the date of the decision so branding
it; an unconstitutional law, in legal contemplation, is
as inoperative as if it had never been passed ... An
unconstitutional law is void. (16 Am. Jur. 2d, Sec. 178)
America is a great Nation because we have always
welcomed immigrants from all over the world. They are
drawn here as America represents freedom and
opportunity. It is a land where people are able to work
hard and achieve their dreams. It is never an option to
reward anyone who does not follow the laws of our land
pertaining to becoming an American citizen. Therefore, I
am completely against any amnesty legislation. Not only
is it wrong for those who are here illegally, it is
completely unfair to the millions of immigrants who have
obtained citizenship legally. ICE has identified that
“terrorism and criminal activity are most effectively
combated through a multi-agency/multi-authority approach
that encompasses federal, state and local resources,
skills and expertise. State and local law enforcement
play a critical role in protecting our homeland because
they are often the first responders on the scene when
there is an incident or attack against the United
States. During the course of daily duties, they will
often encounter foreign-born criminals and immigration
violators who pose a threat to national security or
public safety.” Therefore, we must secure our borders
and empower our local law enforcement though programs
like 287G which allow local agencies to perform
immigration law enforcement functions.
As an attorney, I have seen first hand that some of our
laws pertaining to immigration are subjective and poorly
implemented. Therefore, I will work to make sure that
immigrants who are striving for citizenship through the
legal channels have fair procedures, by cutting
unnecessary bureaucratic red tape thus encouraging legal
immigration.
As so brilliantly written in the Declaration of
Independence, all men are created equal and endowed by
their Creator with the unalienable right to life. This
right is a right that can neither be given nor taken
away and it is a right that exists for all people, both
the born and unborn. To protect and preserve life at
every stage is one of the highest and noblest reasons
for legitimate government.
The institution of family is the most vital and basic
building block of society. In order to most effectively
preserve our society, government has a legitimate duty
and function to preserve and promote the institution of
marriage as our nation has historically defined it,
between one man and one woman.
Our constitution established a government of enumerated
powers. The intention in the 10th amendment of limiting
federal government to only those areas specifically
listed within the Constitution and reserving all other
powers to the states and the people is clear and
inviolable. There is absolutely no constitutional basis
to support the intrusion of the federal government into
the realm of education.
Article 1, Section 8, Clause 1:
“The Congress shall have Power To lay and collect Taxes,
Duties, Imposts and Excises, to pay the Debts and
provide for the common Defense and general Welfare of
the United States; but all Duties, Imposts and Excises
shall be uniform throughout the United States.” The
power given to Congress to tax is limited to specific
provisions as previously stated. Although an income tax
was latter approved, these specific provisions
restraining the purpose of taxes still apply. Obviously,
the federal government has been acting outside its
enumerated powers and has been using taxes to pay for
unconstitutional spending for decades. The only option
is to limit taxing and spending to their Constitutional
parameters. Thomas Jefferson eloquently explained the
general welfare clause that the federal government has
abused in its blatant over taxation and spending.
Jefferson said that the federal government is “not to
lay taxes ad libitum for any purpose they please; but
only to pay the debts or provide for the welfare of the
Union.” Decreasing taxes and spending are an absolute
must constitutionally and such measures will immediately
stimulate the economy, increase production, decrease
unemployment, and put money back into the pockets of the
people where it belongs.
